Documents for registration for workAt the conclusion of the employment contract, the futurethe employee must provide the employer with certain documents without which it is impossible to conclude an employment contract. But for some reason different employers have different lists of documents. Is this lawful? What you really need documents for registration for work?



The list of documents necessary for employment is listed in Article 65 of the Labor Code of the Russian Federation. It clearly states that When applying for a job, you must present the following documents to the employer::



  • Passport or other document proving your identity;

  • employment history;

  • insurance certificate of state pension insurance;

  • documents of military registration;

  • a document on education, qualifications or the availability of special knowledge (for example, a diploma).


But in the case of each document, there are alsonuances. If you are employed for the first time, you do not need to present a work book and an insurance certificate of state pension insurance, because you do not have them, of course. These documents will be issued for you by the employer.



If you do not have a work book for another reason(say, it was lost or damaged), you must write a statement in which you should indicate the reason for the absence of the work record book, and the employer will issue you a new one. If you are getting a part-time job, you do not need to present a work book.



Documents of military registration are provided, if you are military liable or under appealfor military service. A document on education, qualifications or the availability of special knowledge - if your work requires these very special knowledge or special training.



Additional documents for registration at work may be needed, if this specifies the nature of the work. These cases should be envisaged by the RF TC,other federal laws, decrees of the President of the Russian Federation and resolutions of the Government of the Russian Federation. Thus, when employing workers in certain sectors, as well as minors, a medical report is necessary.



In cases not provided for by law, the employer has no right to demand from you any other documents when applying for a job. Sometimes employers require registration at the place of residence, but this contradicts Article 64 of the LC RF: the lack of registration can not serve as an excuse for refusing to apply for a job.



there is a list of documents that the employer can request from you, if on their basis you can be granted certain benefits. These include documents on the composition of the family,documents on the pregnancy or the age of children, documents that confirm the right to other guarantees and compensation (academic title and degree, donation, disability, etc.).



If you are getting a part-time job, then you need to show a passport (or anotheridentity document). A diploma or other document on education or training (or a duly certified copy) may be required from you if a part-time job requires special knowledge.



Also it is worth considering that if you are taking part-time jobs for hard work or for work with harmful and / or dangerous working conditions, you will have to provide the employer a certificate of the nature and conditions of work in your main place of work. All this is indicated in Article 283 of the Labor Code.



As you can see, the list of documents you owepresent to the employer when hiring and signing an employment contract is not so great, you probably will not have to make out any additional information. The employer has no right to demand from you documents for registration for work not provided for by law, and refuse to hire you if you are not going to provide them.



By the way, if the employer still refused you, he must, at your request, state the reason for the refusal in writing. If he does not do this, or if the reason contradicts the Labor Code of the Russian Federation, you have the right to appeal his refusal in court.
